1. Agreement to Attend

By submitting this application to attend the 2026 ITS NM Annual Meeting in Albuquerque, New Mexico (“Event”), the Participant agrees to abide by these terms and conditions (“Agreement”) before, during, and after the Event, and agrees to abide by any and all rules of the Marriott Hotel. The ITS NM Officers, Board, and contracted agents (“ITSNM”) shall have the sole authority to interpret and enforce all rules and regulations included herein, to make any amendments thereto, and to make further rules and regulations as necessary to ensure the orderly conduct of the Event.

2. Attendee Conduct

Event attendee shall not engage in any actions contrary to the best interests of the Annual Meeting or ITSNM. ITSNM may, in its absolute discretion, rearrange or remove such goods or services, or take whatever action ITSNM deems necessary to protect the integrity of the Event, up to and including immediate termination of the Attendee’s registration, expulsion from the Event Location, without liability for refund and without liability for any claims of damages caused by such action.

3. Limitation of Liability

ITSNM shall not be liable, and Attendee, and Attendee’s heirs, agrees to make no claim for any reason whatsoever against ITSNM, the Marriott Hotel for loss, theft, damage, or destruction of goods; nor for any injury, including death, to Attendee’s self, employees, agents or representatives; nor for any damage of any nature; nor for failure to hold the Event as scheduled; nor for any action or omission of ITSNM. ITSNM shall bear no responsibility for the safety of Attendee, Attendee’s personnel, employees, agents, representatives or personal property.

4. Indemnification

Attendee shall defend, indemnify, and hold harmless ITSNM, its officers, directors, employees, agents, and each of them, with respect to any claims, suits, damages, liabilities, losses, expenses, and costs (including attorneys’ fees) (“Claims”) which ITSNM, its officers, directors, employees, agents, and each of them may suffer or be subject to, and which are in any way connected with the Agreement or the presence of the Attendee, Attendee’s personnel, or any Attendee-appointed contractor at the Event; provided, however, that the Attendee’s duty to indemnify, defend, and hold harmless shall not extend to Claims, as are solely caused by the gross negligence or willful misconduct of ITSNM, its agents, or employees. The terms of this provision shall survive the termination or expiration of this Agreement.

5. General

Survival: All provisions of this Agreement which by their nature should survive termination will survive, including without limitation, accrued rights to payment, indemnity, limitation of liability and Attendee’s obligations.

Governing Law and Jurisdiction: This Agreement will be construed and enforced in accordance with the laws of the State of New Mexico.

Severability: If any portion of this Agreement is held to be invalid or unenforceable, all other terms and conditions shall remain in full force and effect.

Amendment and Additional Rules: Any matters not specifically covered by the preceding rules shall be within the sole purview of ITSNM. ITSNM may, at any time, amend or add further rules to these terms.
